Noxious Weed Notice

ATTENTION ERIE TOWNSHIP RESIDENTS

Pursuant to Ordinance #110-A all premises and exterior property shall be maintained free from weeds or plant growth in excess of six (6) inches.  All noxious weeds shall be prohibited.  Weeds shall be defined as all grasses, annual plants and vegetation, other than trees and shrubs provided:  however, this term shall not include cultivated flowers and gardens.

In addition, pursuant to Ordinance #70 and &70-A as amended and in accordance with Michigan Public Act 359 of 1941, It shall be the duty of all owners of land in the Township of Erie on which noxious weeds are found growing to destroy the same before they reach a seed-bearing stage and to prevent such weeds from perpetuating themselves, or to prevent such weeds from becoming a detriment to public health.

All noxious weeds shall be destroyed by the following established two cutting dates:

1st cutting                  June 10, 2024

2nd cutting                 August 10, 2024

Upon failure of the owner or agent having charge of a property to cut and destroy weeds and tall grass, after service of a notice of violation or if the noxious weeds have not been cut and destroyed by the June 10 and August 10 cutting dates, they shall be subject to prosecution.  Upon failure to comply, the Commissioner of Noxious Weeds, or his designate, may enter upon such parcel of land and destroy any such weeds. All expenses incurred in connection with destruction shall be paid by the owner of such parcel of land.  Any expense incurred in such destruction shall be placed as a lien against such land, which lien shall be enforced in the manner now provided by law for the enforcement of tax liens.  (The Township may cut weeds as many times as is necessary on any individual parcel of land to control the growth of noxious weeds or plant growth in excess of six (6) inches.)
