NOTICE OF PUBLIC HEARING AND REVIEW

FOR ADOPTION OF AMENDMENTS TO THE ZONING ORDINANCE

Notice is hereby given that amendments have been proposed to revise the Zoning Ordinance Number 117.  Numerous amendments were recommended by the Township Planning Commission for Erie Township, Monroe County, Michigan at a regular meeting held on February 20, 2018.

A PUBLIC HEARING shall be conducted on the Amendments to Zoning Ordinance number 117, at a Meeting of the Planning Commission for Erie Township to be held on Tuesday, March 20, 2018 at 7:00 PM in the Erie Township Board Meeting Room.

Synopsis (summary) of the proposed changes and updates are as follows:

Section 3.04  General Permit Procedures and Regulations – Add exemption for Accessory Storage Sheds and Farm Stands of 100 square feet or less.

Table 10-2     Permitted Principle Uses In All Districts:

 - Change Solar Power Plant to a BR (Use Permitted by Right) in the I-1 (Industrial District).

 - Change Home Occupation, Class 2 to a S (Special Land Use) in the A-RB (Agricultural  Rural Business District).

Section 11.22           Home Occupation, Class 2

                             - Amend typo in (B)4 to correct section 4.03(A).

- Add section (C) to provide requirements and regulations for Caregivers provided for in the Michigan Medical Marihuana Act.

Section 12.05           OSC (Open Space Communities) Design Standards

- Section (B) 1. Additional Dwelling Units for Dedicated Open Space – update table to provide more options based on Dedicated Open Space.

- Section (B) 2. Additional Dwelling Units for Superior Design – Update section to make options more clear.

- Section (B) 2f. – include AP (Agricultural Preservation) and BC (Bay Conservation) Districts.

Section 20.21           Outdoor Merchandise Sales, Display and Storage

- Section (A) – entirely re-write the section to limit sale to a permanent structure except under very limited circumstances.

- Section (B) – re-write language covering all storage of materials or products in Commercial or Industrial Districts.

Section 20.23           (B) 3, Garage Sales

- Sections a. & b. – change the number of sales and permitted number of sales to the total number of sale days permitted in a 12 month period.

- Section g. – Add section to provide for a request for a sale exceeding requirements of Section(B)3

Section 20.23           (B) 7, Large Public Gatherings – entirely re-write the section and add sections A,B,C,D & E to clarify the requirement and regulations for Large Public Gatherings.

Section 21.02           Definitions

– Add definitions for the following:

                             Michigan Medical Marihuana Act

                             Caregiver 

                             Registry Identification Card

- Re-write definition for Class 2 Home Occupation to clarify any residential occupation outside of the home (living space) and to include any such businesses that have potential to adversely effect the surrounding residential area.

Notice is hereby given that the Erie Township Planning Commission will hold a Meeting and Public Hearing on Tuesday, April 17, 2018 at 7:00 p.m. in the Erie Township Hall, 2065 Erie Road, Erie, Michigan 48133, at which time the following will be considered:

Hearing - The request of Joseph Vidak, 10188 Strasburg Rd, Erie, MI 48133, for a Special Land Use approval for a Home Occupation, Class 2, to operate an auto repair business out of an accessory structure located on his property located at 10188 Strasburg, Parcel #58-05-008-181-00

NOTICE OF ADOPTION OF NEW ZONING ORDINANCE

Notice is hereby given that a comprehensive review has been completed and an updated and revised zoning ordinance text regulating the development and use of land has been adopted by the Erie Township Board, for Erie Township, Monroe County, Michigan at a regular meeting held on July 12, 2016 and became Effective: August 5, 2016

The Erie Township Zoning Ordinance No. 117 as amended, was adopted July 12, 2016 and became effective August 5, 2016 and the Zoning Map was adopted May 13, 2014 and became effective June 1, 2014.

Medical Marihuana Information Minimize

House Bill 4209 has been signed by the Governor and enacts the "Medical Marihuana Facilities Licensing Act" to do the following (in-part):

-- Provide for the licensure of marihuana growers, processors, secure transporters, provisioning centers, and safety compliance facilities.

-- Establish the licensure process within the Department of Licensing and Regulatory Affairs (LARA).

-- Create the Medical Marihuana Licensing Board within LARA to implement the Act, including the licensing process, and give the Board jurisdiction over the operation of all marihuana facilities.

-- Require provisioning centers to pay a tax on their retail gross income, and require the tax to be deposited in a new "Medical Marihuana Excise Fund".

--Require money in the Excise Fund to be distributed to municipalities and counties where marihuana facilities are located, the Michigan Commission on Law Enforcement Standards and the State Police.

Before House Bill 4209 was enacted it was basically illegal to operate a Marihuana Business in Michigan. With this new law there will be a number of potential issues that may need to be addressed, including if or where Marihuana operations of facilities would be located in Erie Township. This issue and a draft Moratorium were discussed by the Planning Commission at the meeting on September 20, 2016. The Planning Commission formed a committee to review the law and recommended that the Erie Township Board adopt the Medical Marihuana Business Moratorium Ordinance to provide time for the Commission to review the new law and to make recommendations on how or if provisions need to be addressed for the Township. 

On December 12, 2017 the Erie Township Board followed the recommendations of the Erie Township Planning Commission to NOT adopted provisions to permit Medical Marihuana Businesses in Erie Township. This decision was made after several meetings, a township survey and a Public Hearing was held to get community input.
