NOTICE OF ADOPTION OF NEW ZONING ORDINANCE

Notice is hereby given that a comprehensive review has been completed and an updated and revised zoning ordinance text regulating the development and use of land has been adopted by the Erie Township Board, for Erie Township, Monroe County, Michigan at a regular meeting held on July 12, 2016 and became Effective: August 5, 2016

The Erie Township Zoning Ordinance No. 117 as amended, was adopted July 12, 2016 and became effective August 5, 2016 and the Zoning Map was adopted May 13, 2014 and became effective June 1, 2014.

Medical Marihuana Information Minimize

House Bill 4209 has been signed by the Governor and enacts the "Medical Marihuana Facilities Licensing Act" to do the following (in-part):

-- Provide for the licensure of marihuana growers, processors, secure transporters, provisioning centers, and safety compliance facilities.

-- Establish the licensure process within the Department of Licensing and Regulatory Affairs (LARA).

-- Create the Medical Marihuana Licensing Board within LARA to implement the Act, including the licensing process, and give the Board jurisdiction over the operation of all marihuana facilities.

-- Require provisioning centers to pay a tax on their retail gross income, and require the tax to be deposited in a new "Medical Marihuana Excise Fund".

--Require money in the Excise Fund to be distributed to municipalities and counties where marihuana facilities are located, the Michigan Commission on Law Enforcement Standards and the State Police.

Before House Bill 4209 was enacted it was basically illegal to operate a Marihuana Business in Michigan. With this new law there will be a number of potential issues that may need to be addressed, including if or where Marihuana operations of facilities would be located in Erie Township. This issue and a draft Moratorium were discussed by the Planning Commission at the meeting on September 20, 2016. The Planning Commission formed a committee to review the law and recommended that the Erie Township Board adopt the Medical Marihuana Business Moratorium Ordinance to provide time for the Commission to review the new law and to make recommendations on how or if provisions need to be addressed for the Township. 

On September 29, 2016 the Erie Township Board adopted a Medical Marihuana Business Moratorium, Ordinance No. 120 to provide for time to adequately review House Bill 4209 and to make recommendations as to what effect it may have on Erie Township or how it may be regulated.
